neither an employee nor subcontractor of Get it App Co. Ltd; The Get
it App Co. Ltd Platform is a web-based communications platform which
enables connections between Clients/Customers and Service Providers
or Vendors. “Clients”/Customers are individuals and/or businesses
seeking to obtain short-term services (“Tasks”) from Service
Providers or products from Vendors and are therefore clients of
these service providers and “Service Providers” or vendors are
businesses/professionals seeking to perform Tasks or sell products
to Clients. Clients and Service Providers/Vendors together are
hereinafter referred to as “Users.” If you agree on the terms of a
Task with another User, you and such other User form a Service
Agreement directly between the two of you.
SERVICE PROVIDERS AND VENDORS ARE INDEPENDENT BUSINESS OWNERS.
SERVICE PROVIDERS AND VENDORS ARE INDEPENDENT CONTRACTORS OF CLIENTS
AND NOT EMPLOYEES, PARTNERS, REPRESENTATIVES, AGENTS, JOINT
VENTURERS, INDEPENDENT CONTRACTORS OR FRANCHISEES OF GET IT APP CO.
LTD. GET IT APP CO. LTD DOES NOT PERFORM TASKS OR SELL PRODUCTS AND
DOES NOT EMPLOY INDIVIDUALS TO PERFORM TASKS OR SELL PRODUCTS. BY
CONNECTING PEOPLE AND BUSINESSES SEEKING SERVICES WITH SERVICE
PROVIDERS AND VENDORS, GET IT APP CO. LTD OPERATES AS AN ONLINE
MARKETPLACE THAT CONNECTS CLIENTS WITH SERVICE PROVIDERS AND VENDORS
WHO WISH TO PERFORM A VARIETY OF TASKS AND SELL A VARIETY OF
PRODUCTS.USERS HEREBY ACKNOWLEDGE THAT GET IT APP CO. LTD DOES NOT
SUPERVISE, SCOPE, DIRECT, CONTROL OR MONITOR A SERVICE PROVIDERS’
AND VENDORS' WORK OR PRODUCTS AND EXPRESSLY DISCLAIMS (TO THE EXTENT
PERMITTED BY LAW) ANY RESPONSIBILITY AND LIABILITY FOR THE WORK
PERFORMED, PRODUCTS SOLD AND THE TASKS IN ANY MANNER, INCLUDING BUT
NOT LIMITED TO A WARRANTY OR CONDITION OF GOOD AND WORKMANLIKE
SERVICES, WARRANTY OR CONDITION OF QUALITY OR FITNESS FOR A
PARTICULAR PURPOSE, OR COMPLIANCE WITH ANY LAW, STATUTE, ORDINANCE,
REGULATION, OR CODE.
The Get it App Co. Ltd Platform is licensed to you, not sold to you,
and you may use the Get it App Co. Ltd Platform only as set forth in
these Terms of Use; The use of the Get it App Co. Ltd Platform may
be subject to separate third-party terms of service and fees,
including, without limitation, such terms of service and fees
imposed by your mobile network operator (the “Carrier”), including
fees charged for data usage and overage, which are your sole
responsibility; You consent to the collection, use, and disclosure
of your personally identifiable information in accordance with the
Privacy Policy. The Get it App Co. Ltd Platform is provided “as is”
without warranties of any kind, and Get it App Co. Ltd’s liability
to you is limited regarding the performance of Services; We will
resolve disputes arising under these Terms of Use through binding
arbitration. By accepting this Agreement, you and Get it App Co. Ltd
are each waiving the right to a trial by jury or to participate in a
class action; Access to certain features of the Get it App Co. Ltd
Platform may require access to information about the location of
your device, such as GPS coordinates; We may, without further notice
or warning and in our discretion, access, store, use, and disclose
the messages, call transcripts, and data about the calls/messages
between and among Users that occur through the Get it App Co. Ltd
Platform for our business purposes, including to provide and improve
customer service and the Get it App Co. Ltd Platform, fraud
prevention, and to identify violations of this Agreement; You agree
not to circumvent the Get it App Co. Ltd Platform by soliciting,
scheduling and/or paying for Services and/or Additional Services
outside the Platform;
2. Intellectual Property Rights:
i. Get it App Cp. Ltd. owns all rights to the intellectual property
and material contained in this Website, and all such rights are
reserved; except for Company owned Logos and Trademarks..
3. Restrictions:
i. You are expressly and emphatically restricted from all of the
following: publishing any Website material in any media; selling,
sublicensing and/or otherwise commercializing any Website material;
publicly performing and/or showing any Website material; using this
Website in any way that is, or may be, damaging to this Website;
using this Website in any way that impacts user access to this
Website; using this Website contrary to applicable laws and
regulations, or in a way that causes, or may cause, harm to the
Website, or to any person or business entity; engaging in any data
mining, data harvesting, data extracting or any other similar
activity in relation to this Website, or while using this Website;
using this Website to engage in any advertising or marketing.
Certain areas of this Website are restricted from access by you and
Get it App Co. Ltd. may further restrict access by you to any areas
of this Website, at any time, in its sole and absolute discretion.
Any user ID and password you may have for this Website are
confidential and you must maintain confidentiality of such
information.

i. “Your Content” shall mean any audio, video, text, images or other
material you choose to display on this Website. With respect to Your
Content, by displaying it, you grant Get it App Co. Ltd a
non-exclusive, worldwide, irrevocable, royalty-free, sublicensable
license to use, reproduce, adapt, publish, translate and distribute
it in any and all media. Your Content must be your own and must not
be infringing on any third party’s rights. Get it App Co. Ltd.
reserves the right to remove any of Your Content from this Website
at any time, and for any reason, without notice.
5. No warranties
This Website is provided “as is,” with all faults, and Get it App
Co. Ltd. makes no express or implied representations or warranties,
of any kind related to this Website or the materials contained on
this Website. Services and Products "booked" or procured on this
platform fall under the specific warranty of the service provider
and product supplier. Get it App Co. Ltd. is a marketplace that
creates an marketplace for buyers and service providers to meet
virtually. Additionally, nothing contained on this Website shall be
construed as providing consult or advice to you.
6. Limitation of liability
i. In no event shall Get it App Co. Ltd. , nor any of its officers,
directors and employees, be liable to you for anything arising out
of or in any way connected with your use of this Website, whether
such liability is under contract, tort or otherwise, and Get it App
Co. Ltd. , including its officers, directors and employees shall not
be liable for any indirect, consequential or special liability
arising out of or in any way related to your use of this Website.
7. Indemnification
i. You hereby indemnify to the fullest extent Get it App Co. Ltd.
from and against any and all liabilities, costs, demands, causes of
action, damages and expenses (including reasonable attorney’s fees)
arising out of or in any way related to your breach of any of the
provisions of these Terms
8. Severability
If any provision of these Terms is found to be unenforceable or
invalid under any applicable law, such unenforceability or
invalidity shall not render these Terms unenforceable or invalid as
a whole, and such provisions shall be deleted without affecting the
remaining provisions herein.
9. Variation of Terms
Get it App Co. Ltd. is permitted to revise these Terms at any time
as it sees fit, and by using this Website you are expected to review
such Terms on a regular basis to ensure you understand all terms and
conditions governing use of this Website.
10. Assignment
Get it App Co. Ltd. shall be permitted to assign, transfer, and
subcontract its rights and/or obligations under these Terms without
any notification or consent required. However, you shall not be
permitted to assign, transfer, or subcontract any of your rights
and/or obligations under these Terms.
11. Entire Agreement
These Terms, including any legal notices and disclaimers contained
on this Website, constitute the entire agreement between Get it App
Co. Ltd. and you in relation to your use of this Website, and
supersede all prior agreements and understandings with respect to
the same.
12. Governing Law & Jurisdiction
These Terms will be governed by and construed in accordance with the
laws of the State of Saint Lucia, and you submit to the
non-exclusive jurisdiction of the Saint Lucia and Court of Appeal
for the resolution of any disputes.
13. Return/Refund Policy
i. Notwithstanding anything set forth herein to the contrary, you
further represent, warrant, and agree (i) to pay all reasonable
out-of-pocket expenses incurred by Get it App Co. Ltd. in connection
with the resolution of any property damage or other claims resulting
from a Service you performed for a Customer, and (ii) that Get it
App Co. Ltd. shall have the right to suspend your Provider account
until it has received payment in full for all such reimbursable
amounts.
ii. As it relates to Products sold on the platform; when you order
from a vendor/seller that fulfills and ships its own inventory, your
return should be sent back to that vendor/seller and subject to
their specific returns/refund policy as some vendor/seller returns
policies may vary. You can view the return/refund policy of each
vendor/seller before you purchase an item by viewing the Returns and
Refunds Policy section of the seller profile page. Typical return
and refund policies range from 14 days to 30 days and from 25% to
100% refund less shipping charges. Returns or exchanges for items
purchased from a vendor/seller that provided a Delivery with Service
(in-home unpacking, installation, assembly, etc.) have to be
scheduled by the seller. During the scheduled return pick-up, the
seller will uninstall or disassemble, and pick up the item.
iii. All vendors/sellers offering Delivery with Service are required
to support scheduled return pickups or exchanges. If a seller does
not offer these methods, or is non-responsive to scheduling an
appointment to return your items, you may contact support@getit.lc
to file a claim. If a Delivery with Services item is missing parts
or damaged through customer misuse, the customer may be charged a
restocking fee based on the condition of the product.
Vendors/sellers must either provide a return address, provide a
prepaid return label, or offer a full refund without requesting the
item be returned. If a seller does not offer these methods to
address your concerns/complaints, you may send an email to
support@getit.lc
14. Exchange/Cancellation Policy
i. A seller may cancel a transaction under the following
circumstances:
a. The buyer did not pay. (The seller may flag a buyer for a payment
not received, chargeback, or cancel ed payment.)
b. Both the buyer and vendor/seller agree to cancel the transaction
before shipment, and the seller has issued the buyer a full refund.
c. The vendor/seller has decided to refuse service to the buyer, and
if the buyer has already paid, the seller has issued a full refund,
including shipping.
d. The buyer did not receive the item(s) ordered, even though the
seller has provided proof of shipping, and the seller has issued a
refund for the item. (Refunding shipping is optional and subject to
the shipping policy of the vendor/seller.)
e. The buyer and seller agreed that the buyer could return the item
to the seller for a refund.
f. The seller has received the returned item and issued a refund to
the buyer for the item. (Refunding shipping is optional and subject
to the shipping policy of the vendor/seller.)
ii. All cancellations must follow these policies:
a. The order meets one of the above criteria.
b. The buyer has not yet received their item. (Received orders don’t
qualify for cancellation.)
c. The seller refunds the buyer in full, except as described above
15. Service Cancellation
i. Get it App Co. Ltd cancellation policy for specific Services is
as follows:
a. Cancellation by Customer. As a Customer, you may cancel your
scheduled Service appointments through the App at any time, subject
to the following: i. Services Booked 24 Hours in Advance
b. If you cancel more than 24 hours before a scheduled Service
appointment, there is no cancellation fee.
c. If you cancel between 2-24 hours before a scheduled Service
appointment, you may be charged a $10.00 cancellation fee.
d. If you cancel less than 2 hours before a Service appointment, you
may be charged a $50.00 cancelation fee. ii. Services Booked Less 24
Hours in Advance
ii. For Services that were booked between two to twenty-four (2-24)
hours before the scheduled Service appointment, you may be charged a
$10 cancellation fee if you cancel less than two (2) hours before a
Service appointment.
iii. For Services that were booked less than two (2) hours before
the scheduled Service appointment, including Services scheduled as
"Now" appointments, you may be subject to a $10 cancellation fee if
you fail to cancel such appointment within five (5) minutes after if
you booked your job.
iv. Cancellation by Provider:
a. As a Provider, although you may cancel your scheduled Service
appointments through the App if necessary, please understand that
your cancellations are serious matters and may result in the
suspension or deactivation of your Provider Account. If you are more
than fifteen (15) minutes late for a scheduled appointment (note:
the scheduled time for a “Now” appointment is one (1) hour from the
time you are selected by your Customer) or fail to complete a
scheduled Service, you shall be deemed to have cancelled such
appointment. When you cancel a scheduled Service appointment, the
Get it App Co. Ltd Platform generally notifies your Customer to
resubmit the request for Service. Get it App Co. Ltd cannot
guarantee that a cancelled Service appointment will be selected by
another Provider and rescheduled or that the Service request will be
completed. Thus, your cancellation or failure to timely show up to
perform a scheduled appointment could negatively impact your
Customer and the Get it App Co. Ltd Platform. As a result, such
conduct may adversely impact your Provider rating.
b. PLEASE BE ADVISED THAT YOUR CANCELLATION OF (A) ANY “NOW”
APPOINTMENTS, (B) ANY SCHEDULED APPOINTMENTS WITH LESS THAN
TWENTY-FOUR (24) HOURS NOTICE, OR (C) TWO OR MORE SCHEDULED
APPOINTMENTS WITHIN A THIRTY (30)-DAY PERIOD IS A VIOLATION OF THE
TERMS OF THIS AGREEMENT, WHICH MAY RESULT IN THE SUSPENSION OR
DEACTIVATION OF YOUR PROVIDER ACCOUNT.
16. Delivery Policy
All deliveries are subject to the specific service provider and
vendor and will vary based on the product or service procured and
the address and ease of finding your desired location. The estimated
delivery date is when your order should arrive. Generally, the
estimated delivery date is based on a combination of the processing
time for the items you ordered, the transit time, and today’s date.
For example: If the processing time for an item you purchased is 3-5
days, and the transit time for the delivery method you chose is
usually 2-4 days, your estimated delivery date is 5-9 days from toby
day. Every vendor/supplier or service provider will have a delivery
date specific to each job. Please ensure to read the specific
delivery policy as it may vary vendor/seller and service provider.
You can view the delivery policy of each vendor/ and service
provider before you purchase an item by viewing the Returns and
Refunds Policy section of the seller profile page.
17. Transaction Currency
i. All transactions will be conducted in Eastern Caribbean dollars
(XCD). Exchange rates are subject to ECCB daily rates.
18. Security Capabilities and policy for transmission of payment
card details
i. What information do we collect and how do we use it?
a. When you place an order through this website, we need to know
your name, e-mail, and credit card/debit card details; if paying by
credit/debit card. This allows us to process and fulfill your order
successfully. It also helps us in maintaining your account.
ii. How does Get it App Co. Ltd. protect customer information?
a. When you place orders, we use a secure server. The secure server
software (SSL) encrypts all information you input before it is sent
to us. Furthermore, all of the sensitive customer data we collect is
protected by several layers of encryption and several layers of
security to prevent unauthorized access.
iii. Credit card details
a. All credit card payments are processed securely through our
Payment Service Provider. Get it App Co. Ltd. does not store any
credit card information on our servers.
iv. What about cookies?
a. "Cookies" are small pieces of information that are stored by your
browser on your computer's hard drive. Our cookies do not contain
any personally identifying information. They allow you to place your
online order and to login once you are subscribed. Most Web browsers
automatically accept cookies, but you can usually change your
browser to prevent that. You do not need cookies enabled to use the
website. The Website uses "session cookies" which are only stored in
your browser's memory for the length of time you are actually logged
in.

a. By using our website, you consent to the collection and use of
this information by Get it App Co. Ltd.. If we decide to change our

vi. Payment gateway info
a. Our payment options presently available are limited but, most
importantly, safe and secure. We offer Credit Card payments for all
our registered users. Credit Card payments are made directly through
a SSL Encrypted software to ensure your personal details are kept
safe. None of your payment details are stored – this ensures you
will be happy with the security of your transaction. In accordance
with the recommendations of Payment Card Industry Security Standards
Council, customer card details are protected using Transport Layer
encryption - TLS 1.2 and application layer with algorithm AES and
key length 256 bit.
